
CONDITIONS
OF TRASPORT
General
conditions The term “passenger” is used to designate all persons
who are being
transported on the basis of these General Transport
Terms and Conditions for Passengers and Vehicles. The term “transport
enterprise” and/or “company” is used to designate the MOBY S.p.A.,
Via Conservatorio, 17 - 20122 Milano - Italy (C.F. 4846130633 - P.I.
13301990159). The transport enterprise is obligated, in accordance
with the aforementioned General Transport Terms and Conditions, to
offer transport service. Through the ordering or the purchase of a
corresponding ticket, each passenger explicitly declares himself/herself
to be aware of these conditions and is obligated to maintain and accept
these conditions in their entirety.
1. - TRANSPORT REGULATIONS: The
transport contract between the transport enterprise and the passengers
is subject to Italian Law, inasmuch as the travel conditions hereinafter
are subject to no other regulations. The transport enterprise does
not assume any liability for damage caused by strikes, by cancelled
and/or late departures due to poor weather conditions, by technical
or mechanical defects on the ship, by incidents which cannot be answered
for by the transport enterprise, by quarantines, war or any form of
Acts of God. The transport enterprise maintains the right to change
departure times, conditions, and transport rates at any time. The arrival
and departure times have been calculated on the basis of the distances
to the individual ports and due to good weather conditions. The transport
enterprise is not to be held liable for any delays caused by port operations.
The planned ship duty can be altered by the transport enterprise without
having to give due cause. Please take a valid prospectus with you,
as, among others, important telephone numbers are given in the prospectus.
2. - VALIDITY OF THE TICKET: The ticket is issued
under a name, is non-transferrable, and is valid for only those crossings
specified
on the ticket. The passenger is to keep the ticket and present it on
request of an officer or a representative of the transport enterprise.
Should the individual not be in possession of a valid ticket, twice
the regular ticket amount will be charged and the individual may be
liable to pay for damages. Acknowledgements from travel agencies for
crossings in the form of a letter cannot be accepted. For incorrect
information on the number of persons, vehicles, etc., the difference
in amounts is to be paid immediately. When incorrect information on
lengths and heights are given, one may be placed in a waiting list
and embarkation refused. Open date tickets cannot be issued.
3. - CANCELLATIONS/REIMBURSEMENTS: For cancellations of bookings, fees will be charged, independent of
whether the tickets have been issued or not. This is carried out as
follows (day of cancellation will not be counted): SARDINIA - CORSICA:
down to 30 days before departure: 10% of the travel price; 29 days
– 48 h before departure: 20% of the travel price; from 48 hours to
1 hour before departure: 50% of the travel price. Should the person
not appear or cancel at a later date a 100% fee is charged: ELBA: down
to 30 days before departure: 10% of the travel price; 29 days – 3 days
before departure: 20 % of the travel price. Should the person cancel
later no reimbursement will be made. The ticket, however, can be used
against a previous booking for a crossing to Elba during the year of
issue (possible seasonal changes, etc. are calculated). No reimbursement
and no claim to ticket utilisation can be granted for not appearing
for the trip without previous cancellation. PEX RATES and CAR TARIFF:

4. - LOSS OF THE TICKET: The booking office must be notified
immediately of loss of a ticket or theft of a ticket. Replacement tickets
may only be issued against payment. The reimbursement is effected on
presentation of the MOBY replacement ticket 3 months after the scheduled
time of departure and after previous investigation into the unused
original tickets.
5. - BOOKING CHANGES/REIMBURSEMENTS: Per booking
change for a trip after a booking confirmation has been made or after
acceptance of a seat offer (also by telephone), € 10,00 will be charged
(in addition to the possible necessary extra charge for changes in
the seasonal period, number of persons or change in vehicles). Tickets
which have been changed by hand and do not have a MOBY Lines Europe
stamp will not be accepted. PEX RATES and CAR TARIFF see point 6. Reimbursements
can only be applied for through the agency where the ticket was purchased
and when the ticket has been certified (per route) with the date, stamp
and duly signed by the authorised port agent or paymaster within 4
weeks after departure. For partial cancellations (e.g. decrease in
the number of persons, cabins, etc. the following fees will be charged:
down to 30 days before departure: 10%; up to 10 days before departure
20%. Subsequent reimbursements for route changes or departure changes
cannot be made on location.
6. - PEX RATES and CAR TARIFF: can only
be cancelled against 100% cancellation costs. No reimbursements for
not appearing for the trip/partial route. CORSICA AND SARDINIA: the
tariffs can be changed for a certain fee. For each change we will charge
you 10 € for Corsica routes and 20 € for Sardinia routes (plus the
possible difference between the former price and a necessary higher
price). ELBA + BONIFACIO-S.TERESA line: the reservation/ticket cannot
be changed. PEX rates and CAR TARIFF only available in limited numbers
on departures in Best Price A.
7. - EMBARKATION: Before boarding the
ship (30 minutes for passengers and 90 minutes for passengers travelling
with vehicles), all passengers must check in.
8. - VEHICLES/SPECIAL
CHARACTERISTICS: Please observe the specified vehicle categories. A)
gas-propelled vehicles must be registered extra at the time of the
booking and for embarkation. B) The alarm systems in vehicles must
be turned off while the vehicles are on the ship. C) When supplying
information on the lengths and heights, we require the overall dimensions
of the individual vehicle including possible rear carrier or roof carriers.
Cat. 1 and 2 is only allowed for vehicles under 1.85 m. The extra charge
for over-height is only allowed for roof luggage. Vehicles without
roof luggage from 1.86 m in height (as per vehicle registration document)
must be registered as special vehicles in general and, in addition
from 2.21 m in height, an extra cost for over-height will be charged
(when specified). When incorrect information on lengths and heights
are given, one may be placed in a waiting list and embarkation refused.
9. - CHILDREN AND TEENAGER: Under 18 years of age must be accompanied
by an adult. The transport of children under 4 years of age is included
in the price. They, however, do no have the right to a seat or a cabin
bed. Children from 4 years of age to 11 inclusive may travel at a 50%
discount off the passenger rate (without taxes).
10. - PETS: Dogs and
cats must be inoculated (Inoculation passport necessary). Please observe
the entrance regulations of the countries. Dogs must wear a muzzle
on board and are not allowed in cabins or lounges on the ship.
11.
- IMPORTANT INFORMATION: In accordance with L.D. No. 251 from October
13, 1999, and in connection with EU-Instruction 98/41 from June 18,
1998, we are required to make the following known to our customers:
ART. 4 PASSENGER-INFORMATION - Each passenger requiring special help
or assistance in emergency situations must make the transport enterprise
aware of this fact before embarkation. All passengers must provide
the following information when making reservations: surname, first
name (or initial), sex, age category (baby, child, adult). Any changes
in relationship to the abovementioned information which may occur between
the time of reservation and the crossing must be provided immediately.
The personal data will only be used during the specified times and
in conformity with the EU-Instruction. The traveller is liable for
maintaining the entrance regulations of the individual countries. Costs
which incur due to missing travel documents may be invoiced by the
transport enterprise.
12. - BOOKING CABINS AND COACH SEATS: Passengers
with reservations for cabins and recliners must report immediate after
embarkation to the reception desk on the ship. 90 minutes after departure,
these berths will be given to passengers on the waiting list.
13. -
PORT TAXES, SURCHARGES, LOCAL TAXES are not included in the passenger
prices and will be charged extra. Changes are possible at any time.
14. - INSURANCE: We recommend taking out travel cancellation insurance.
15. - JURISDICTION: Naples has jurisdiction. Italian law is applicable.
16. - RESERVATIONS: Reservations for the ferries from the transport
enterprise are made via MOBY Lines Europe GmbH, Wilhelmstr. 36-38,
65183 Wiesbaden or via other agents from the transport enterprise. |

CONDITIONS OF TRASPORT
You
will find here below a resume of transport conditions, which
you may find useful. Transport
conditions are quoted
integrally elsewhere
in this Site.Tirrenia takes charge of transport at the terms and
conditions stated in the "Regulations for the Transport
of Passengers and Accompanying Baggage" and in the "Regulations
for the Transport of Vehicles Accompanying Passengers",
which may be seen also at the Company Offices and at the onboard
Commands. In addition,
the Italian
Navigation Code or, in the event of missing applicable Code provisions,
the articles of the Italian Civil Code are applicable. Ticket purchase implies the acceptance of such conditions to all extents.
FARES, FEES and BOOKINGS
All fares are inclusive of V.A.T. (if due) and of fees. In fact, upon
ticket purchase, in addition to the ticket price, also the presale
fee or the accommodation or garage space assignment must be paid. Such
fees cannot benefit of any type of reduction or facilities, and are
not refundable in case of modification or cancellation of the trip.
The cost of bookings is of € 3.87 per Passenger and of € 5.42 per accompanying
vehicle.
At the Tirrenia Ticket Offices and at the authorized Travel Agents
it is possible to book much in advance accommodations and garage space,
without contemporary ticket purchase. Advance booking is not possible
from 15th May to 15th September, when only final ticket purchase is
possible for departures from 15th June to 15th September.
For online bookings from this Web Site, or by phone from the Booking
and Information Center, the terms specified in the relevant pages of
this Site apply.
Accommodations booked remain at your disposal until the term specified
in the booking form. Upon the expiry of such term, if the corresponding
tickets have not been purchased, the booking shall be automatically
canceled, with no refund right.
On the contrary, in the event of booking confirmation and final ticket
purchase, the presale fees or seating/garage fees shall not be
requested, since the booking fees, of the same amount, have already
been paid.
BOARDING
If your trip destination is an Italian harbor and you have no accompanying
vehicle, you must be ready for boarding not later than fifteen
minutes before scheduled departure. If traveling to Tunis, you
must be ready for boarding at least one hour in advance, to carry
out custom formalities.
If you have an accompanying car, you must be on the ship side at
least two hours before the scheduled departure time. After such terms
the boarding right expires. For boarding in Tunis, you must contact
Company Offices 48 hours before departure.
TRIP CANCELLATION AND TICKET REFUND
If you cancel your trip, you have the right to ticket refund. The
following penalties shall be applied:
• 10% for trips canceled up to the day preceding the departure;
• 25% for trips canceled the same day of ship departure.
In any case, the refund right becomes prescribed after six months
from the departure date.
No refund is due for uncanceled trips.
EXCLUSIVE USE
When cabins are assigned for exclusive use, half of the full fare
shall be paid for each unused bed. The Company reserves the right
of not granting cabin exclusive use in some periods of the year.
ON BOARD CONTROLS
In the event that, during the trip, a Passenger should be found lacking
in the documentation giving him the right to the special reduced
fare applied upon the issuing of the ticket, he shall be obliged
to pay the difference between the reduced fare, already paid, and
the full fare, increased by 100 %.
ACCOMPANYING VEHICLES
Applicable fares are inclusive of loading and unloading expenses.
CARS.
Fare categories are:
1st category: up to 4 meters length;
2nd category: more than 4 meters length.
Motor cars of more than 1.80 meters height, with or without roof
baggage, are charged according to the "Caravan" fare.
It is mandatory to declare, upon ticket purchase, the transport of
liquid gas powered vehicles. Failing such declaration, the boarding
right is lost.
It is forbidden the boarding of vehicles carrying dangerous or harmful
materials, not allowed by applicable regulations and of containers
with any flammable materials.
CARAVANS, MINIBUS, MINIVANS, BAGGAGE TRAILERS, TOWED BOATS, CAMPERS
For
all such vehicles the linear meter fare applies. Fractions smaller
or larger than 25 cm. are rounded
respectively to the lower or higher
half meter. The "Pullman" applies to minibus with more
than 8 seats. Minivans beyond the limit of 15 cub. mt. are considered
commercial vehicles and must be shipped with Bill of Lading.
BUS
If the bus is accompanying passengers, the linear meter fare applies.
Otherwise they are considered commercial vehicles and must be shipped
with Bill of Lading.
BOATS OR ITEMS ON THE ROOF OF THE ACCOMPANYING CAR
In
the event that the total car height is beyond 1.80 meters, the "Caravan" fare
shall be applied and the fare for the boat or item on the car roof
shall also become due.
If the boat length is bigger than the car length, the larger length
fare shall be applicable to the car.
Windsurf, canoes and bicycles carried by hand pay the relevant "Surf" or "Bici" fare.
Windsurfs, small boats, canoes and baggage on the accompanying car
roof are transported free of charge, provided that their length is
less than the car length and that the overall height is less than
1.80 meters.
ACCOMPANYING BAGGAGE
Carry on baggage may be put in the cabin or given accommodation.
Are considered and admitted as carry on baggage parcels containing
personal items only. Carry on baggage that, due to its size, does
not fit into the cabin, must be put in the ship luggage van.
High value items, jewels or money may be deposited at the on board
Commissioner Office, provided they are not of large size.
ACCOMPANYING ANIMALS
Transport of accompanying dogs and cats is possible. Dogs must wear
the muzzle and during the trip shall be lodged in the on board
dog house. Small sized dogs are allowed in the cabin, with Captain
approval. Cats must be housed by the owner in small cages or baskets.
Animals care and maintenance during transport are at the owner
charge and risk.
The following documentation is required for the animal traveling
with you:
•
for all lines: a veterinary certificate stating that the animal is not sick;
•
for connections to Sardinia: in addition to the first one above, a veterinary
certificate of anti rabies vaccination;
•
for the connection to Tunis: in addition to the first one, which must testify
that the animal has not been subject to contagious sickness during the last
six weeks, also a veterinary certificate of anti rabies vaccination issued
at least one month, but not more than six months, before departure.
DOCUMENTS FOR ABROAD
If you are departing for Tunis, you must have all documentation required
to enter Tunisia. The Company bears no responsibility in the event
that you cannot disembark for missing or inadequate documentation.
